Rude off duty Cop

My 25 year old daughter was heading home from work one day on a five lane highway she was on there was a lane to only turn right with a green arrow ,

since she was in the far right lane but behind 3 yes 3 cars not turning she decided to use the wide shoulder to get around these 3 cars and make the arrow to turn, out of nowhere a car ahead decides to do this also , to avoid hitting this car she(my Daughter) honked the horn and swerved to avoid and kept going after calming down she noticed this car following her and it made her kinda nervous , after getting home and greeting her kids and fiance, she hears a knock on the door , she opens it to see a policeman there who says he is giving her a citation for wreckless driving as he observed her incident at the intersection previously that day, and he was giving her a warning about littering for a cigarette butt she discarded out the window. when she asked if he drove a gold car (the one that tried to cut her off , he became more angry and dodged the question by asking if she had any questions about her citation, she asked then for his name and badge #. He gave her his name and # and then said  I dont like your attitude , YOU WILL be Getting a fine for Littering instead of a warning! Does anyone know if this is legal or just plain being an ass? She is not a bad driver or person just wanted to get home to see her kids
Never had an accident , or speeding ticket ,
I'd just like some feedback about off duty cops
doing this to other people.

 Another parent in denial that their child could be in the wrong. You dont think that maybe your daughter alley'd everyone on the right a bit too fast? If she was in a "right turn only" lane, are you saying that the 3 cars in front of her were all breaking a traffic law, including the off-duty cop? Smells a little fishy..dont ya think? Oh but of course, adult kids NEVER lie or bend the truth to their parents. And as far as the citation for littering, cudos to the cop! As a smoker, I must say one of my pet peeves are those who toss their cigarette butts on the ground. This is littering just as it would be if one threw a whole bag of trash on the ground. You condone this behavior?? Cigarette butts do not go away. They stay in the gutters, stay until it rains and then they end up in our water ways. I may have the right to kill myself with those things but I dont have the right to make everyone else live in a giant ash tray....and neither does your daughter! Be a parent and tell your daughter to suck it up because she behaved badly. THIS is how one teaches their kids to mature into a respected citizen.

Most police agencies have existing policies that spell out off duty behavior. I reveiwed your comments and have a probable solution. You have the right to call the agency's Internal Affairs Bureau to report your situation. In most cases they will not take phone in complaints therefore you will have to appear in person and sign an affidavit.
The behavior of the officer who appeared at your daughters residence the next day is very questionable to me. He is compounding the case by adding additional charges such as littering. That officer has levels of supervision he must answer to. I 'll bet that if you start making a few phone calls to the police agency regarding this issue you will probably find out this is not the first time that this particuar officer has had run ins such as you described.

i would dispute the charges, and see if they can find any motorists that were there that day to have an eyewitness, cops protect they're own. go to the local news.

In most areas I'm aware of, driving on the "wide shoulder", the "narrow shoulder" or any "shoulder" to pass traffic is illegal and dangerous, and worthy of a citation.  

This is also why I keep a ketchup bottle in the console of my vehicle; it looks kinda cool to see the ketchup sprayed down the side of their car.  Bonus points if you can get it through an open window.  

What the hell... if they wreck their car, how are they gonna catch up to you?  They were in too goddam big a hurry to catch your plate number anyway.
